AVS information indicating a relationship between Cyprus AMAX Minerals and Cyprus Amax Energy Inc. is erroneous. Newly submitted Exhibit 27 page 3 depicts the relationship between CYCC and all parent companies. Comment 5.) AVS reveals that the ownership of Cyprus AMAX Coal Co. by Cyprus AMAX Minerals was terminated on 4/20/94. Please have the operator clarify this relationship. I Believe the structure of Cyprus AMAX Minerals has changed since this update. Response 5.) As indicated on newly submitted Exhibit 27 page 9, 100% ownership of Cyprus Amax Coal Company by Amax Energy Inc. was established on April 20, 1994. Amax Energy Inc. in turn is 100% owned by Cyprus Amax Minerals Company as depicted on newly submitted Exhibit 27 page 11. Comment 6.j Ronald W. Stucki is listed in AVS as a Vice President for Cyprus Western Coal Company with a beginning date of 3/13/90. Ronald W. Stucki is not listed on the permit pages as a Vice President. Please have the operator confirm if Stucki remains as a officer of Cyprus Western Coal Company. Response 6.) As indicated on newly submitted Exhibit 27 page 7, Mr. Stucki is no longer associated with Cyprus Western Coal Company. As documentation of this resignation, CYCC submits the enclosed copy of Mr. Stucki's resignation letter which has been used as confirmation of his resignation at other Cyprus operations. Comment 7.j D.J. Friedman -Assistant Secretary, James T. Kerley -Director, Taylor Jr. - Director, Philip C. Walsh -Director, Francis J. Kane -Vice President/Treasurer, and Fred B. Park -Vice President are listed on the permit pages as retired from Cyprus AMAX Minerals Co. (page 2.03-20). These officers however, remain on AVS. To end them out in AVS we need documentation of their resignations or corporate minutes that verify they are not associated with Cyprus Amax Minerals Company. Please have the operator submit the documentation. Response 7.} As indicated on newly submitted permit page 2.03-30, Friedman, Kerley, Taylor, Walsh, and Park have resigned from their respective positions with Cyprus Amax Minerals Company. As documentation of these resignations, CYCC submits the enclosed certified statement from the Assistant Secretary of Cyprus Amax Minerals Company. Francis J. Kane, however, is not listed on page 2.03-20 (revised 4/4/94) as resigned. Mr. Kane remains affiliated with Cyprus Amax Minerals Company as shown on newly submitted Exhibit 27 page 13. Comment 8.) AVS documentation shows that C.A. Campbell, Jr. was expired as a Director from Cyprus AMAX Minerals Co. on 5/4!94. The permit pages reveal that he remains as a Director. Please have the operator confirm that C.A. Campbell, Jr. remains as a Director of Cyprus AMAX Minerals Company and update the permit pages accordingly.
