<br />April 6, 1982 <br />Mined Land Reclamation Division <br />Colorado Department of Natural Resources <br />1313 Sherman Street <br />Denver CO 80203 <br />Gentlemen: <br />Subject: Keenesburg Coal Mine (Permit No. C-028-81 )/ <br />Stipulation #6 - Water Rights <br />iii iiiiiiiiiiiiiiii <br />We have reviewed Hal Simpson's, Assistant State Engineer, letter <br />dated February 19, 1982, which addresses the water rights aspect of our <br />permit. In response to Mr. Simpson's position, we will modify our proposed <br />plan as follows: <br />1) We will not take any credit for the unconsumed portion of <br />the nontributary water used for irrigation. Therefore, <br />the Blaney-Griddle analysis previously transmitted will <br />not be utilized and a discussion of the appropriateness <br />of the analysis is unnecessary. This new approach modifies <br />our depletion estimates to the water system 6y 25.4 acre- <br />feet per year resulting in a first year depletion of 75.5 <br />acre-feet and subsequent year depletions of 35.5 acre-feet. <br />2) The annual report submitted in February of each year will <br />reflect the actual amount of pit inflow the previous year, <br />the amount of make-up water released the previous year and <br />the proposed make-up water for the coming water season. <br />3) The impact of rainfall runoff is accounted for because any <br />water which enters the pit will be pumped and metered.
