Findings of the <br />Colorado Division of Minerals and Geology <br />for the <br />Meadows No. 1 Mine <br />Phase II Bond Release Application <br />I. Procedures and Summary of the Review Process <br />Sun Coal Company applied for a paztial bond release under the Colorado Surface Coal <br />Mining and Reclamation Act for topsoil replacement and revegetation work completed <br />at the Meadows No. 1 Mine. The mine is located in Routt County on State Highway 40, <br />approximately five miles southwest of Milner, Colorado. The mine area is located in <br />portions of Sections 14, 23, 24, 25, and 26 of Township 6 North, Range 87 West of the <br />6th Principal Meridian. The land within the permit area is owned by John A. and Allie <br />M. Eilts (114 acres) and Grassy Creek Coal Company (76 acres). <br />An application for Phase II bond release was received by the Division on March 29, 1995. <br />The application was deemed complete on May 22, 1995, after the Division received proof <br />of publication of the approved public notice. Sun Coal Company published notice of the <br />bond release application in The Steamboat Pilot once weekly for four consecutive weeks, <br />beginning April 13, 1995. The operator requested that 25% of the bond be released on <br />100 of the 190 originally permitted acres, in the amount of $217,986.00. The 100 acres <br />for which release was requested include the azea of the mining pit. <br />The Division scheduled and conducted a bond release inspection on June 20, 1995. A <br />subsequent inspection, for the purpose of verifying topsoil replacement depths was <br />conducted on July 21, 1995. A third inspection, for the purpose of determining the extent <br />of erosion from the site, was conducted on August 28, 1995. The site inspections were <br />conducted in accordance with Rule 3.03.2(2). Representatives of the Division, Sun Coal <br />Company, and an owner of land within the permit boundary were present during the June <br />20, 1995 and August 28, 1995 inspections. <br />The Division finds that, based on the review process history, the requirements for seeking <br />release of performance bonds as set forth in Rule 3.03.2 have been met Copies of <br />written notices as required by Rule 3.03.2(1)(a) have been submitted to the Division. <br />Proof of publication of a public notice, in accordance with Rule 3.03.2(1)(b), has also <br />been submitted. A site inspection was held in accordance with Rule 3.032(2). <br />Mcadows No. 1 Mine 3 Phase 11 Bond Release <br />
