<br />3 <br /> <br />I. PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br />Rocky Mountain Bank and Trust applied for partial bond release under the Colorado <br />Surface Coal Mining Reclamation Act following reclamation of the Ia Plata No. 1. The <br />mine is located in La Plata County, in portions of Section 28, & 29, T35N, R11W, <br />approximately 5 miles southwest of Hesperus, Colorado. <br />An application for Phase 1 & 2 bond release was received by the Division on December <br />15, 1995. The application was deemed complete on February 6, 1996, after the Division <br />received proof of publication of the applicant's public notice. Rocky Mountain Bank and <br />Trust published notice of the bond release application in the Durango Herald once <br />weekly for four consecutive weeks, beginning December 12, 1995. Rocky Mountain <br />Bank and Trust also notified land owners within and adjacent to the mine permit area, <br />and other interested parties of the application for bond release, as required by Rule <br />3.03.2(1). <br />No comments, written objections, or requests for an informal conference regarding the <br />bond release application were received by the Division. <br />The Division scheduled and conducted a bond release inspection on Apri125, 1996. The <br />site inspection was conducted in accordance with Rule 3.03.2(2) with the exception that <br />it was delayed due to weather conditions. Present for the inspection were Harry Ranney, <br />Colorado DMG, Dan Baker and Michael Savage, representing the Rocky Mountain Bank <br />and Trust. No others were present for the inspection although all land and mineral <br />owners were notified of the inspection by mail two weeks prior to the inspection date. <br />
