<br />Dear Mr. Klein:
<br />Accompanying this transmittal is one copy of the Colorado Division of Minerals &
<br />Geology's (DMG) Proposed Decision Form for Technical Revision TR-31, along with
<br />copies of all permi[ revision application materials and supporting documentation
<br />associated with this Technical Revision. Technical Revision TR-31 addresses submittal
<br />of a mine subsidence evaluation provided in fulfillment of the specific requirements of
<br />Stipulation 28 to the previous DMG approval of Technical Revision TR-29 (refer to TR-
<br />29 Federal Mailing of 8/5/97). Technical Revision TR-29 addressed phased expansion of
<br />the existing Sanborn Creek Mine including installation and operation of ahigh-capacity
<br />longwall mining system, increases in mine production to approximately 4.0 million tons
<br />of coal per year, and modification of the mine surface facilities and coal handling
<br />systems to accommodate the production increase.
<br />Please note that the mine subsidence report was originally submitted as supporting
<br />information in conjunction with the Technical Adequacy responses for Technical
<br />Revision TR-29. The DMG subsequently determined and requested that the report be
<br />submitted as a Technical Revision. An application for Technical Revision was prepared
<br />and submitted under the designation of TR-30, however, another Technical Revision
<br />application was filed at about the same time and was received by the DMG and
<br />designated as TR-30, so the DMG changed the Technical Revision designation for the
<br />subsidence report submittal from TR-30 to TR-31.
<br />Specifically, this submittal includes the Proposed Decision Form for Technical Revision
<br />TR-31, signed by the operator's authorized representative, acopy of the subject mine
<br />subsidence report, and copies of associated revised permit materials (permit text, tables,
<br />maps, and appendices, as applicable). Revised permit materials are to be replaced or
<br />inserted in the Somerset and Sanborn Creek Mines Permit document as indicated by the
