<br />Summary <br />The Review Process <br />Colorado Yampa Coal Company (CYCC) currently holds Permit No. <br />C-81-071 for the Eckman Park Mine, Mine 1 and Mine 2 which are <br />adjacent surface mining operations in Routt County, Colorado. <br />The permit expired on December 14, 1992. Six months prior to <br />that date, as required, CYCC applied for permit renewal. The <br />original permit was issued on December 14, 1981 and expired on <br />December 13, 1986. However, due to a delay associated with a <br />major permit revision related to post-mining topography, the <br />renewed permit was issued on December 14, 1987. Due to the <br />discrepancy in dates, the permit corresponding to this findings <br />revision will be back-dated to begin December 14, 1991. <br />CYCC has completed mining at the Mine 1, Mine 2 and Eckman Park <br />complex. Most facilities have been transferred to the Foidel <br />Creek mine, a sister underground operation permitted by <br />Twentymile Coal Company, permit #C-82-056. Mine operations and <br />associated permitting actions by these two mines are closely <br />linked, as they shared many of the same facilities as well as <br />have overlapping permit boundaries. <br />The original approval document for the current operation is the <br />Office of Surface Mining's (OSM) February 1980, approval with <br />stipulations for a major modification to the Surface Mining and <br />Reclamation Plan for Energy Fuels Corporation's (prior owner) <br />Mine 1, Mine 2 and extension into Eckman Park (Permit No. <br />C-79-177). The Technical Environmental Analysis (TEA) prepared <br />by OSM was adopted by the Division as the approval document. <br />Associated with the TEA is an addendum prepared in conjunction <br />with a technical revision application dated September, 1985, <br />which allowed mining within a 30 acre tract of previously <br />unleased Federal Coal. The addendum to the TEA updated the <br />status of the operation and documented compliance with the Act. <br />For administrative purposes, the Division subsequently issued <br />Permit C-81-071 to CYCC for Eckman Park, Mine 1 and Mine 2. <br />The first renewal process was initiated with the June, 1986, <br />renewal application submitted by CYCC. Processing of the renewal <br />application was delayed by submittal of a permit revision <br />application which proposed significant alterations to the <br />approved post-mining topography. That application was submitted <br />in December, 1986 and approved, with modifications, on August 30, <br />1987. Adequacy letters addressing concerns identified by the <br />Division, OSM, and the Bureau of Land Management (BLM) with <br />regard to the renewal application were sent to the applicant on <br />August 22 and August 29, 1986. <br />4 <br />
