It is possible that the current <br />species diversity criteria may be overly stringent, particularly <br />for the steep south and west facing sites dominated by shadscale <br />and other low growing shrubs on the native landscape. <br />Please provide a commitment to reevaluate the existing species <br />diversity success standard and, if appropriate, to submit a plan <br />to apply remedial revegetation treatments to areas which appear <br />unlikely to meet final success criteria. The success criteria <br />evaluation/remedial treatment plan should be submitted within 12 <br />months of receipt of this mid-term review. <br />2.05.6 Subsidence Survey Monitoring and Control Plan <br />8. With the installation of Ute Water Conservancy District's new <br />six foot diameter steel Plateau Creek raw water pipe, replacing <br />the existing 29" concrete pipe, certain sections of text and <br />maps will need to be updated. Specifically text on pages 20-1, <br />20-3, and possibly 20-6 and 20-7 will need to be amended, along <br />with map Exhibits 29 and 30, which denote the "29" Ute Water <br />Main. <br />9. Please review Exhibit 46 "Manmade Features Map", and ensure that <br />all existing structures and irrigated lands are depicted on the <br />map. Please amend the map if any structures have been <br />constructed on the permit area since the map was last updated, <br />or otherwise are not depicted on the map. <br />IV. BONDING <br />The Division has reviewed the adequacy of the reclamation bonding <br />instruments, and we have also reviewed the adequacy of the worst <br />case reclamation cost estimate. Our cost estimate review indicates <br />that the current bond amount of $2,903,016.00 remains adequate to <br />cover the cost of reclaiming the existing disturbance in accordance <br />with the approved reclamation plan. <br />The Division currently holds a $2,603,016.00 corporate surety bond <br />issued by Frontier Insurance Company, and a $300,000.00 corporate <br />surety bond issued by Utica Mutual Insurance Company of New York. <br />The Division is aware that Frontier Insurance Company's rating has <br />recently been downgraded, and it may be necessary for the operator <br />to replace the Frontier surety bond. Our investigation of this <br />matter is continuing, and a final determination will be <br />forthcoming. The Utica Mutual Insurance Company bond fully <br />complies with applicable requirements. <br />8 <br /> <br />
