In <br />the absence of compliance with local land use plans, t}ke <br />reyuired reclamation cannot be accomplished. <br />Moreover, the Coal Act provides that no application <br />for a permit shall he approved unless the application <br />demon:;trates and tike Division finds that granting the per- <br />mit will not conflict with any designation of unsuitability <br />issued pursuant to C1iS 39-33-126. CRS 34-33-114(2)(d). <br />The first basis listed in CRS 34-33-126(1)(b) for a desig- <br />nation of unsuitability far surface raining operations is <br />that such operations will be "incompatible with state or <br />local land use plans or programs." Thus the grant of a <br />pe rnlit by tlke Division is directly dependent upon com- <br />patibility with local land use controls. Therefore, local <br />yoverrkment approval should he obtained before the state <br />acts.*/ <br />The previous Act, the Non-Coal Act and the Coal Aot <br />all require compliance by the applicant with local govern- <br />ment Plana.
