This well is not registered, permitted or
adjudicated under Colorado law and to the best of our knowledge, has
not been operational since the mid-1980's.
On April 20, 1994, a letter was sent to Mr. Tatum stating that
Basin would lower the well pump to below the water level at its
expense. Mr. Tatum's April 28, 1994 response stated that if the well
could be.restored, he would be glad to discuss this with us. Mr. Tatum's July 5 response stated
that if the well is not damaged, this matter of the well will be put
to rest.
On July 11, Mr. Tatum, Mr. Joe Dudash, and Mr. Ralph Lopez met at
the Tatum Stockwater well to re-measure the water depth. With
everybody participating, and using a 300 foot water indicator meter,
the depth was measured at 43.5 feet. Mr. Tatum mentioned that he and
his ranch hand had measured the well that morning and had a dry well.
He then stated they had used string with a chain link £or a weight as
a measuring device. He said that they could not get their string past
approximately 100 feet. The beeper on the water meter first indicated
water at 102 feet. The contention all along by Mr. Tatum that the
