The intent of the monitoring program <br />was to obtain quantity and quality date from flowing ponds. <br />However, a review of the historic data and discussions with the <br />person conducting the monitoring work indicate that data has been <br />obtained from stagnant or nondischarging ponds. I think you will <br />agree with me that this does not provide the type of hydrologic <br />information the program was designed to develope. Therefore, <br />unless the Division disagrees, stagnant or nondischarging ponds <br />will not be monitored, except for a notation that indicates the <br />ponds are not discharging. <br />I do not believe this modifies the existing monitoring program, <br />thus a revision to the existing permit is not required. It is <br />Orchard Valley's opinion that the above is a clarification of the <br />existing monitoring program.
