Banta. <br />Dimsion Director <br />On December 10, 1991, you gave me letter requesting a hearing before the Board <br />concerning the commencement of reclamation at G.E.C. Thts letter indicated <br />that you requested a meeting with Mr. Renner in a November 22, 1991 letter and <br />that you did not feel the Division responded to the request. The Division <br />received the letter November 25, 1991, and an on-site inspection was arranged <br />for December 10, 1991 in response to your request. We apologize for any <br />inconvenience which may have occurred due to Mr. Renner's absence; however, he <br />was in Washington, D.C. at the time of the meeting. <br />You may be interested to know that the Division filed for a request for ruling <br />on a Motion for Summary Judgment on October 21, 1991. A copy is enclosed for <br />your files. As you know, the Division is underbonded to complete reclamation <br />at the site, and it is our hope that additional money can be recovered by this <br />process. <br />Finally, we ask that you clarify your request for a Board Hearing, so that tt <br />corresponds to the provisions of Rule 1.14 regarding Declaratory Orders. This <br />regulation allows you to petition the Board for a Declaratory Order to <br />terminate controversies, or to remove uncertainties as to the applicability of <br />any rule or order of the Board. At a minimum, include the information <br />required by 1.14(4). Describe the issues you would like to discuss, the <br />actions you would like the Board to take, and the anticipated time needed for <br />the hearing. <br />STATE OF COLORADO <br />
