This conclusion ie based on the information submitted by Cyprus <br />orchard Valley on September 23, 1993 and the assumption that election of Kanjiro <br />Uehara to "Office of Director of the Corporation" does not give Kanjiro the <br />authority to control Cyprus Orchard Valley Coal Corporation's operations. Please <br />review the attached documents for further clarification. <br />Based on the Colorado Regulations and the documents submitted by Cyprus, it ie <br />the opinion of the Assistant Attorney General that Mitsubishi does not "own or <br />control" Cyprus Orchard Valley Coal Corporation ae that term ie defined in <br />Colorado Rule 1.04 (83a). The Colorado Division of Hinerals and Geology is <br />therefore requesting that the AVS Branch of Program Support remove Mitsubishi ae <br />a shareholder of Cyprus Orchard Valley Coal Corporation.
