J ~ -Z- <br />Proposed Decision <br />Nucla Mine <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />one stipulation, the application for a permit to conduct coal mining by <br />Peabody Coal Company for the Nucla Mine. <br />The approval decision is based on a finding that the proposed operation <br />will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et ~., and the <br />Regulations promulgated pursuant to the Act. <br />The permit application and the stipulation will become a binding part of <br />the permit upon approval. The stipulation is as follows: <br />1. PEABODY COAL COMPANY IS DIRECTED TO ANNUALLY MONITOR THE <br />POST-MINING TOPOGRAPHY OF BACKFILLED AND REGRADED SURFACES OF THE <br />DISTURBED AREA. MONITORING FOR THIS PURPOSE SHALL CONSIST OF A <br />CONTOUR MAP (CONTOUR INTERVAL NOT TO EXCEED 5 FEET) PRODUCED FROM <br />AN ANNUAL SURVEY UTILIZING FIELD OR AEROPHOTOGRAMMETRIC TECHNIQUES <br />ACCEPTABLE TU THE DIVISION. THE POST-MINING TOPOGRAPHIC MAPS SHALL <br />BE SUBMITTED TO THE DIVISION FOR REVIEW AND APPROVAL ON AN ANNUAL <br />BASIS. THE FIRST SUBMITTAL IS DUE JANUARY, 1984. <br />
