-12- • <br />The Division approves the post-mining land use and finds that the <br />affected areas will be restored in compliance with Rule 4.16. (Kule <br />2.01.6(Z)(1)). <br />III. Cultural and Historic Resources - Rules 2.04.4, 2.05.6(4)) <br />Information pertaining to cultural and historic resources can be found in <br />the report included under tab 5 of the permit application. <br />Tfre applicant contracted Western Cultural Resource 14anagernent, Inc. to <br />conduct an intensive on site cultural resource inventory. The survey <br />consisted of a 100° pedestrian survey as well as literature reviews. <br />Uuring the on site survey two aboriginal open campsites were located and <br />recorded within the permit area. <br />Both sites contained the same types of materials: ground and chipped <br />stoned artifacts. Ilo features such as fire hearths or rock aligmnents <br />indicating buried structural features were observed. Neither one of the <br />located sites is recommended for eligibility to the National Register of <br />Historic Places for the following reasons: <br />1. The sites have been disturbed by cultivation and'~other <br />prat ices; <br />2. The absence of fire pit activity, surface or <br />subsurface activity, or ceramics and; <br />3. The absence of any diagnostic projectile points <br />precludes accurate datiriy of the site. <br />Based on the results of the applicant's on site survey as well as <br />information received from the State Historic Preservation Officer, the <br />proposed operation will not adversely affect any areas considered <br />eligible to be placed on the National Register of Historic Places. <br />IU. Geology - Rules 2.04.5 and 2.04.6 <br />Geologic information is presented in Volume II Section 6 of the Nucla <br />P1ine application. Detailed reyional and site specific geology was <br />presented which included structure, stratigraphy and overburden <br />assessment. Cores from seven drill holes were analyzed to identify any <br />acid-forming, toxic forming, or alkalinity producing materials 'within the <br />overburden, interburden or near coal underburden. No unsuitable <br />concentrations existed for mercury, cadmium, lead, copper, boron, <br />selinium, or nickel. Possible problems were identified with <br />concentration of molybdenum and the acid-base potential for the spoil <br />material. <br />
