or prospecting, who is not one of the parties or authorized agents thereof, unless they have a pass <br />consisting of written approval from one of those authorized to issue such passes. Either the POFP <br />or the POSP may issue passes. <br />20. POFP Right to Access The POFP can remain on-site at all times. This applies particulazly <br />during pocket removal. If the POFP is not present and a Group 1 pocket is encountered, the POSP <br />will attempt to contact the POFP so he may be present if he wishes. If the POFP is not available, <br />he may designate a representative to be present as long as the representative does not interfere <br />with the POSP's operations. In either case, the POSP is not bound to cease pocket removal, but <br />will photograph and log material removed. The POFP will be notified and given the opportunity <br />to view the material at the POSP's workshop as soon as possible after removal. <br />21. R~uirements to Document Operations. During the mechanized mineral recovery or pocket <br />excavation, the POSP will set up and maintain a calendaz-type logbook in which the following <br />will be recorded: <br />a) Important daily operating events <br />b) Accident, fire, and emergency reports <br />c) Working equipment logs including operators, equipment type, and operating hours <br />d) Personnel on site <br />e) Passes issued and names of personnel to whom passes are issued <br />f) Visitors or unauthorized persomreI and actions relating to <br />g) Pocket discoveries, including an estimate of premium pieces, pocket classifications, and quality <br />estimations <br />h) Photographs, photographs taken, or videotapes produced <br />i) Drav~ngs and sketches relating to mining and mineral recovery <br />j) Times and dates and topics of government inspections <br />k) Notice of citations issued and explanations <br />1} Decisions taken as result of visits, inspections, and citations <br />m) Names and Cities with addresses and telephone numbers of government Inspectors <br />The Logbook wifI be made available to the POFP and copies wilt be made as necessary. <br />22. Inventor~Controt Responsibilities. Inventory control of production is the responsibility of <br />the POSP. The POSP guarantees the safety of all mineral crystals and mineral specimens and any <br />other material having value recovered from the property. <br />23. Production Designation After production of crystallized minerals and mineral specimens, <br />both parties will jointly agree an the designation of the pocket qualities--Group 1, Group 2, and for <br />Group 3--and they will jointly decide which pockets will take priority in cleaning and preparation. <br />The pockets will be kept intact and transported to the POSP workshop for cleaning and <br />preparation. The POFP and the POSP agree all reasonable efforts will be made to re-piece and <br />repair pockets in order to maximize value. Group I pockets will be cleaned, prepped, and offered <br />for sale prior to Group 2 pockets. Group 2 pockets will be cleaned and prepped after Group 1 <br />pockets are ready for sale or if no Group 1 pockets are found. Group 3 pockets will not be <br />cleaned, prepped, nor offered for sale. Disposition of Group 3 pockets will remain up to the <br />POSP's sole discretion. <br /> <br />
