XVIII. Coal P <br />- Rules 2.05.3(8) <br />There will be no coal processing waste produced under this renewal, therefore <br />Stipu]ation No. 12 which requires sampling and analysis of coal waste is no <br />longer needed. The application is in compliance with the requirements of this <br />section. <br />XIX. Mine Facilities, Coal Handling Structures. Support Facilities - <br />Under the permit renewal there will be no mine or support facilities or <br />structures present on the site. The Division finds the application to be in <br />compliance with the requirements of this section. <br />XX. Roads - Rules 2.05.3(3). 2.07.6(2)(d)(iv) and 4.03 <br />Kaiser Steel Resources disturbed a small area within 100 feet of the <br />Highway 69 right-of-way during reclamation of the sediment ponds and <br />associated diversions at C.C.M.C. No. 1 in March, 1991. <br />Kaiser Steel Resources solicited approvals for such a disturbance from the <br />Colorado Division of Transportation and Huerfano County following receipt of <br />Notice of Violation 92-008. Both agencies indicated that such a disturbance <br />was outside of their jurisdiction in letters received by the Division on <br />July 15, 1992. The Division provided an opportunity for a public hearing on <br />the issue in public notices printed in the Huerfano Daily World on July 30, <br />1992 and August 7, 1992. The Division received no requests for a public <br />hearing following notification. <br />The Division finds that the disturbance and associated reclamation of the <br />segment of the north interceptor ditch which falls within 100 feet of the <br />outside right-of-way of Highway 69 will not adversely affect the interests of <br />the public or landowners. <br />The remainder of the 1983 Findings Document remains in effect. The Division <br />finds the application to be in compliance with the requirements of this <br />section. <br />_12_ <br />
