<br />Summary <br />The Review Process <br />~~ <br />Lorencito Coal Company, LLC, submitted an application for a new permit on December 23, <br />1996. The mine will be developed on portions of 17,862 acres of the Hill Ranch, located <br />approximately 22 miles west of Trinidad, Colorado in Las Animas County. The application was <br />submitted by Greystone Development Consultants on behalf of Lorencito Coal Company. The <br />application was reviewed by the Division and found complete on January 2, 1997, as required by <br />Rule 2.07.3(1). Notification of the filing of a complete application was forwazded to the <br />applicant and the appropriate governmental agencies. <br />The Division queried the Applicant Violator System for the first time on December 27, 1996 on <br />the applicant, Lorencito Coal Company, LLC. The system returned an "issue" recommendation. <br />The system was again queried on January 9, 1997 and again returned an "issue" <br />recommendation. <br />On January 13, 1997, the Division received notification from the State Historic Preservation <br />Office (SHPO) that mining should not commence until all cultural resources in the areas to be <br />affected have been identified, evaluated for National Register criteria, and avoidance or <br />testing/data recovery has been completed. <br />On January 13, 1997, the Division received notification from the Division of Water Resources <br />stating that [hey have no objections to the mining application a[ the present time. <br />The Division conducted apre-permitting inspection on January 15, 1997 to observe activities <br />being conducted under an amendment to Notice of Intent CX-96-218 for the A.P. Maxwell <br />Development Co. Test pits had been established at two locations in Cow Canyon where portal <br />facilities will be established. Minor road improvements were noted as approved and disturbances <br />were limited to approved aeeas. <br />On February 4, 1997, the Division received notice from the U.S. Fish and Wildlife Service that <br />due to staffing constraints and workload, the Service would be unable to provide comments on <br />the application. <br />On February 7, 1997, the Division met with Lorencito Coal Company, LLC and their <br />representatives to discuss mining plans, adequacy issues, and scheduling. <br />The Colorado Division of Wildlife provided comments to the Division by FAX on February 26, <br />1997. Numerous concerns were cited including the importance of the habitat proposed to be <br />affected, impacts to sensitive species, increased sedimentation to streams, and reclamation and <br />revegetation of the surface mine disturbance. <br />The Division forwazded an adequacy letter, incorporating all comments received, to the <br />applicant's representative, Greystone Development Consultants on Mazch 3, 1997. <br />
