<br />done simply as a way to dispose of it, instead of having waste rock piles all over the project <br />site. The Contractor did not indicate that this would be a cost item and therefore, no field <br />order or purchase order was completed authorizing the work. The Contractor was well <br />awaze of the need to obtain written authorization prior to commencing what was felt to be <br />extra work. <br />Three sepazate "stockpiles" of riprap are present at the north end of the East Pit, and <br />comprise approximately 165 cubic yazds, by measurement. North to south they aze as <br />follows: <br />• Stockpile #1: approximately 50 cubic yards, all oversize (15"+) rock mixed <br />with approximately 25 percent pit run sand and small rock. <br />• Stockpile #2: approximately 70 cubic yazds all oversize (15"+) rock. <br />• Stockpile #3: approximately 45 cubic yards, 90% of which falls within <br />specifications of 8"-15" diameter, and could be used to complete the riprap <br />portion of Chen's Hill Ditch. <br />"Stockpiles" #1 and #2 are considered waste material by the Owner and should not have <br />been left at this location without prior authorization. The OWNER may have to pay to <br />contract future work to remove this waste rock if the landowner objects to its presence. <br />FINDING: This claim addresses two issues. First, payment for work completed in <br />preparation for a task that was deleted. The work was not fully complete which is why the <br />rema;ning piles are not to specification. Second, payment for rock placed in existing <br />struchtres. <br />CWL is claiming they quamed a large quantity of rock to be placed behind six concrete <br />structures that were deleted from Task i2d). They had begun to produce to riprap for this <br />task. Once the task was deleted they did not separate the riprap into the specified sizes, <br />which is why the piles do not meet specifications. CWL feels they should be compensated <br />for then preparatory work. <br />John Nelson, said the material in the stockpiles was not "quarried". It was exposed during <br />the course of the grading activities for the East Pit. He estimated a couple of hours to <br />generate these piles. Using the same logic as in Item #5, I feel it is appropriate to pay for <br />some preparatory work in advance of items that are subsequently deleted. Only the <br />material in Stockpile #3 will be considered. Using a figure of $10.00/cubic yard, $450.00 <br />will be paid for producing this material. Payment will also be made for hauling rock to the <br />concrete structures and gully, although the Project Manager did not agree to pay for hauling <br />riprap to the 6 completed concrete structures and the gully. I estimate four hours of dozer <br />time to produce the riprap and four to haul and place the rock @ $90.00/ hour for a total <br />of $720.00. Payment due is $1170.00. <br />22 <br />
