<br />The drawings included with the Special Conditions show a plan view of the concrete drop <br />stnu7ures CWL built. 1t is unclear to this day which way they should face The General <br />Conditions 1993, General Bid Specification #11, 'Plans and Working Drawings ;states: 'The <br />drawings if arty, included with this specification are complete and adequate for construction. " <br />RESPONSE: The CONTRACTOR was informed several times about the orientation of the <br />drop structures. On 5-3-94, Harry Rammey and John Nelson surveyed the locations. Preston <br />Mease was present at that time and discussed the orientation. <br />CWL's subcontractors excavated for the first structure on Saturday, June II. YTtey formed and <br />poured concrete ai 10:00 am. Monday lone 13th. They also excavated for 2 more structures <br />that day, and set the forms for the second stntcture John Nelson was on site at 12:00 p.m., but <br />didnY inform arryone that he though they were backwards until 3:00 p.m. The concrete crew left <br />and CWL almost couldnY get them back <br />RESPONSE: John Nelson was on site and unloaded the grass seed at 12:30 PM. He then <br />talked to Al, foreman of the concrete contractor, about the wrong orientation of the <br />structures. This was done earlier than 3:00. Al then went to town to call Tom Matot, the <br />concrete subcontractor. The other two workers stopped work to wait for orders from AI or <br />Tom.) <br />In a phone conversation with lohn Nelson on June 22, he said they had finally found Harry <br />lianrtey, and he confirmed the fast structure had been built the way he had designed them <br />RESPONSE: John Nelson was on the Project site on June 22, 1994. The OWNER cannot <br />confirm a telephone conversation such as is described. <br />This $800.00 claim is actual cost rn labor and equipment to remove the form works, backfill the <br />excavation, re-excavate and reset forms, with overhead <br />CWL has requested compensation on this work DMG has of j`ered $400.00, half the cost. <br />When asked how they arrived at their figure, they said by cutting CWL's cost. <br />Response: No evidence has been provided to the State to support the cost of $800.00. The <br />CONTRACTOR must provide evidence that the $800.00 is actual cost in labor and <br />equipment to remove the form work, etc. <br />The General Conditions, Number 11, states that "While every effort has been made to have <br />the plans and drawings free of errors and ambiguities, any such points must be brought to <br />OWNER'S attention immediately." <br />The Project Manager, having discussed the orientation of the drop structures with Preston <br />Mease, was not made aware of any errors ambiguities in the drawings. Since Mr. Mease <br />understood the proper orientation of the drop structures, but his workers did not, some of <br />16 <br />
