The State failed to inspect the work promptly ar required by the General Conditions <br />1993, #30 Acceptance and Final Payment: "4I'ithin ten days after the Contractor's <br />declaration of completion of the work, the OWNER will make a final inspection of the <br />work to determine whether the work has been completed in accordance with. the <br />ptochase order contract and collateral documents. If arty punch-list rendts from such <br />final inspection, the Contractor shall promptly rectify all items appearing thereon. " We <br />completed all work on July 12th. DMG inspection war dated July 25th. <br />As a result of DMG's failure to promptly inspect, item #5 on final inspection was in <br />error. We built this ditch to specification Heavy rains washed sediment down and <br />covered the riprap. We hand placed more riprap on August 9th. I don't know when this <br />was inspected, but it also was covered with mud I was later informed that it war still <br />not adequate I then had an employee go place more riprap. He said heavy rains had <br />eroded the end of the channel away and some riprap had washed away. On October <br />6th I was informed that it still wasnY acceptably and that on top of the erosion of the <br />roc/S the other pan of the ditch was full of mud and that it war Hooting into the Energy <br />fuel Coals sediment pond. <br />Response: The CONTRACTOR notified the Project Manager on July 13, 1994 that the <br />project was completed. A review of the final inspection report cleazly shows that the final <br />inspection date was July 20, 1994, 7 days after the date the Division was notified that CWL <br />had completed all work. The inspection report was dated July 25, 1994 when the Project <br />Manager returned to the office after further field responsibilities and a weekend, and <br />completed the report. CWL was promptly notified of deficiencies in the work. <br />The ditch was reinspected and photographed on August 17, 1994 by the Project Manager. <br />There was no evidence that riprap had been placed in the ditch in accordance with the <br />specifications of Task 3. Radio station KRLM in Canon City provided the attached report <br />which shows precipitation for July. The weather report does not substantiate the <br />Contractor's assertion that there were heavy rains in the area. <br />FINDING: The typed copy of the Final Inspection and Certificate of Completion had a <br />blank space for the date of final inspection. This could be misleading since the report was <br />dated July 2S, 1994 as described by the IMP response. This is the date Mr. Mease was <br />referring to. John Nelson showed me his hand written copy of the report. The hand written <br />copy of the document is filled in with the July 20, 1994 date. Based on the information <br />provided by the IMP, the field report and field notes of the IMP representatives, the final <br />inspection was conducted on July 20, 1994 and is within the ten days as required by the <br />General Conditions. There is no evidence of negligence. <br />The July precipitation records provided by KRLM show only .07 inches of rain on July 13 <br />and a trace on July 4, 12 and 19. These are the only days showing precipitation prior to <br />5 <br />
