This memo is in response to Costilla County, Permit No. M-80-
233. The County Commissioners and the Administrator for the County
Commissioners are trying desperately to come into complete
compliance with the gravel pits. This particular gravel pit has
been used as a land fill for at least twenty years.
The mining only resumed very recently as a result of the Cease
and Desist order at the neighboring Sierra Grande site.
This land fill is scheduled to cease operations in October of
this year. The State Department of Health may grant an extension
for an additional year as a result of complying with hardship
criteria in locating another facility to take the county's refuse.
The County Commissioners and the County Administrator realize
and understand that the public is best served if there is no
adverse impact to ground water use. They are willing to do
whatever is reasonable and necessary in protecting the public
against contamination of ground water that is put to any use
agriculturally, domestically, etc.
The county is strapped financially but is willing to do what
is reasonable and necessary to find ways to monitor the ground
water.
It appears that the water that collects in this pit is not
ground water at all but simply run off from the irrigation
processes and rain.
The neighboring site M-94-103 is clearly impacted by the
irrigation process and the local ditch rider has acknowledged as
much. That same ditch runs near the land fill area. It is the
belief of the commissioners that seepage from irrigation process
has resulted in the standing water which is only observed during
the irrigation season.
