A copy of the decision <br />is attached for your convenience of reference. <br />We have reviewed the decision and accept the determinations set forth therein. When we <br />requested the last extension we advised the Bureau that we would use our best efforts during the <br />one year extension to develop an opportunity for continued operations on the Lease and, that if <br />nothing materialized, we would relinquish the Lease. In furtherance of our efforts during the last <br />extension, we implemented a variety of efforts to secure development of the Lease. For example, we <br />retained a consulting engineering firm to evaluate the feasibility of an on-site electrical generation <br />facility given the proximity of electrical transmission lines to the Lease. Despite a lot of initial <br />interest in the potential project in the summer and early fall of 2001, a definitive arrangement with a <br />reputable company could not be consummated. <br />Accordingly, per our discussions of last year, we are advising the Bureau of the decision of <br />Kerr Coal Company to relinquish the Lease. This letter constitutes such relinquishment. <br />
