This letter acknowledges receipt of the Decision, dated July i, 2002, on the Expiration of
Suspension of Operations and Production for the above referenced Lease. A copy of the decision
is attached for your convenience of reference.
We have reviewed the decision and accept the determinations set forth therein. When we
requested the last extension we advised the Bureau that we would use our best efforts during the
one year extension to develop an opportunity for continued operations on the Lease and, that if
nothing materialized, we would relinquish the Lease. In furtherance of our efforts during the last
extension, we implemented a variety of efforts to secure development of the Lease. For example, we
retained a consulting engineering firm to evaluate the feasibility of an on-site electrical generation
facility given the proximity of electrical transmission lines to the Lease. Despite a lot of initial
interest in the potential project in the summer and early fall of 2001, a definitive arrangement with a
reputable company could not be consummated.
Accordingly, per our discussions of last year, we are advising the Bureau of the decision of
Kerr Coal Company to relinquish the Lease. This letter constitutes such relinquishment.
