OSMRE has determined <br />that the two technical revisions do not constitute modifications to the <br />approved mining plan under 30 CFR 746.18. Based on this review, and the <br />approval of the Resource Recovery and Protection Plan (R2P2) by the Bureau of <br />Land Management (BLM), these revisions may be approved under the terms of the <br />cooperative agreement. <br />The permit revision for the addition of three Federal leases has been <br />determined to constitute a modification of the approved mining plan in <br />accordance with 30 CFR 746,18(d)(4)> and will require approval by the <br />Assistant Secretary for Land and 24inerals Management. During OSMRE's initial <br />review and a review by BLM, the following concerns were identified: <br />1. Western Fuels Association Inc., needs to submit data on the average <br />annual depletion of surface flows in the Upper Colorado River Basin <br />due to the mining and reclamation at the Deserado Mine. <br />2. The BLM has indicated that impacts on water resources due to mining <br />development in leases C-8424, C-8425 and C-0126669 needs to be <br />addressed in the Colorado Mined Land Reclamation Division's findings <br />of compliance document (see enclosed letter dated December 23, 1985)• <br />3• The BLM has also expressed concern about the increase in size of the <br />refuse disposal areas adjacent to Darwin Reservoir. The effect of <br />the increase in these areas on stock watering and the mitigation of <br />the lose of a stack watering facility need to be addressed. <br />
