This change would be an "alternative land use" as defined in Section 1.04(71), and
would require the Division's approval.
You may request the change in use by submitting a Technical Revision that updates the reclamation plan to reflect
the proposed Commercial or Industrial land use. The plan should include the information required by Section
2.05.5(1) and address the criteria listed in Section 4.16.3, paragraphs (1) through (5). The updated reclamation
plan should also specify the plan for reclaiming the truck scale.
If the animal shelter is to be developed less than two years after the Division's approval of the change in land use,
then the parcel would be subject to the revegetation success criteria of Section 4.15.10(2), that is the ground cover
of living plants shall be adequate for erosion control.
The bond liability period for the parcel would continue until the requirements of Section 3.02.3 are met, that is
until you demonstrate the planned land use has substantially commenced and is likely to be achieved, and the
revegetation is adequate for erosion control.
If you have further questions, do not hesitate to call me.
Sincerely,
i ~. lc~~..~_
Tom Kaldenbach
Environmental Protection Specialist
DIVISION OF
MINERALS
GEOLOGY
RECLAMATION
MINING•SAFETY
cc: Bob Utter, P& M Coal Mining
Daniel I.
