<br />V. Permit Variances <br />According to the findings document an approximate original contour <br />variance has been granted for the areas of the Mine No. 2 and Mine <br />No. 3 portals. There are some discrepancies in the permit <br />application document about whether the variance was requested in <br />section 2.06.5 (page 2.06-3). In section 4.27 the operator <br />indicated that a variance was requested in section 2.06.5; however, <br />in section 2.06.5 the permit indicates that Bear Coal company is <br />not requesting a variance from reestablishing approximate original <br />contour. Since a findings was made to allow a variance from <br />approximate original contour, the Division believes that the permit <br />application incongruities are simply an oversight. Therefore, Bear <br />should submit a revision that revises the text to clarify this <br />situation. This can be done in conjunction with the revision that <br />is being submitted to incorporate requested changes. <br />
