Box 25367 <br />Denver, CO 80225 <br />Dear Bill: <br />~~ ~~ <br />FEa 2~, <br />0 N rp VIS10~ <br />~~CLAMpT40 <br />In accordance with Colorado Surface Coal Mining Reclamation Act regula*.ions <br />4.19 Protection of Underground Mining and 4,22 Concurrent Surface and Under- <br />ground Mining, Trapper Mining Inc. is requesting a variance to the 500-foot <br />barrier, measured horizontally, that shall be maintained between surface and <br />underground mining activities. To comply with these reg ul a[ions governing <br />variances to this rule, ioint approval must be granted by Colorado Mined Land <br />Feclamation Division (CMLRD) and by Mine Safety and Health Administration <br />~ AiSHA) . <br />Trapper Mining Inc. is applying for the variance so that improved coal <br />resource recovery may be obtained from the area. It is estimated that the 75 <br />acres included within the 500-horizontal barrier contains 930,000 tuns of sur- <br />face mineable coal. The area for which the variance is requested is shown un <br />t9ap TR-32-1 fur the 1987 C Pit Permit Revision, and on Map M-8 for the 1988 to <br />1992 Permit Renewal submitted to the CMLRD. <br />Most of the underground workings shown on these maps are abandoned room and <br />pillar mining areas for which an estimated 85~ extraction was accomplished. <br />No currently-active headings fall within 500 horizontal feet of the planned <br />blasting area, although during the permit term [he possibility exists. <br />Due Co the nature of the geology and the vertical separation of the two mining <br />operations, Trapper feels the health and safety of the underground miners will <br />not be compromised. To insure the safety of Empire Energy's Eagle No. 5 Mine <br />workers, blasting within the 500-foot horizontal barrier area will be done <br />during Dnpire's shift changes when none of their workers are in the area. To <br />insure the safety of Empire activities, Trapper Mine will use a controlled <br />blasting schedule which will be coordinated with Empire Energy Corporation. <br />cont. <br />P.O.
