III IIIIIIIIIIIIIIII <br />ECG NECA <br />S Coal Company Seneca Coal Company <br />December 15, 1995 <br />Ms. Susan Burgmaier <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203-2273 <br />RE: Yoast Mine Permit C-94-082, Stipulation 5 - Pond 011 <br />Dear Ms. Burgmaier: <br />Stipulation no. 5 to the Yoast Mine Permit C-94-082 required <br />submittal of a technical revision which demonstrates that pond 11 <br />will be located as near as practicable to the disturbed area, and <br />that the pond embankment has a minimum static safety factor of 1.3. <br />This revision was to be submitted within 180 days of permit <br />issuance or roughly around February 5, 1996. This is a request for <br />an extension of this deadline of at least another 180 days. <br />The basis for this request is that the earliest this pond will be <br />constructed is late summer or fall of 1997. It most probably will <br />not be needed until sometime in mid to late 1998. During the CDMG <br />inspection on September 15, 1995 with Mr. Larry Routten, this <br />drainage was inspected to assess the prospect of moving the pond <br />closer to the disturbed area. It did appear there is one spot for <br />the potential new location. Seneca will evaluate if the area is <br />large enough to construct the pond. As stated in the inspection <br />report, the only apparent complication seems to be the potential of <br />unstable slopes on the north side of the drainage to fail and <br />impact the pond site. Because of the current workload, the fact <br />that this site needs additional detailed contouring which can not <br />be completed until next spring, the potential need for stability <br />analysis, and the projected timetable for construction of the pond <br />the request for an extension seems justifiable. <br />Should you or any other members of the Division have any questions <br />regarding this information, please do not hesitate to contact me. <br />Sincerely, <br />Michael G.
