FINDINGS OF THE COLORADO MINED LAND RECLAMATION <br />DIVISION FOR THE GRAND MESA COAL COMPANY <br />RED CANYON MINES <br />Explanation of Findings <br />Pursuant to Rule 2.07.6(2) of the regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Mined Land Reclamation Division <br />(Division) or the Board must make a number of written findings prior to the <br />issuance of a permit. These findings are based on information made available <br />to the Division that demonstrates that the applicant will be able to operate <br />in compliance with the Colorado Surface Coal Mining Reclamation Act and the <br />regulations promulgated pursuant to the Act. <br />This findings document is organized according to the major disciplines <br />reviewed during the permitting process. The written findings which must be <br />made by the Division are addressed under the appropriate discipline subtitle. <br />For example, findings concerning the protection of endangered or threatened <br />fish and wildlife species will be found under the subtitle of Fish and <br />Wildlife. Also, any specific approvals required to be made by the Division <br />pursuant to Rule 4 and thus requiring a written finding pursuant to Rule <br />2.07.6(2)(m) are discussed under the appropriate discipline subtitle. <br />I. Legal, Financial and Compliance Information - Rule 2.03 <br />The legal, financial and compliance information sections of the permit <br />application can be found on pages 8a through 34. <br />Pursuant to Rule 2.07.6(2)(8), and on the basis of evidence submitted by the <br />applicant, the Division finds that Grand Mesa Coal Company does not own or <br />control any operations which are currently in violation of any law, rule, or <br />regulation, or any provision of the Surface Mining Control and Reclamation Act <br />or the Colorado Surface Coal Mining Reclamation Act. The Blue Ribbon Mine, <br />which is also a partnership involving Tremont Mining Inc., Eagle Mining Inc. <br />and Pinebrook Mining Company, and managed by Western Associated Coal Corp., <br />has received two Notices of Violation during 1984, from the Division, which <br />are not listed in the application. Both violations (NOV C-84-004 and <br />C-84-049) have been abated. An assessment conference for NOV C-84-004 was <br />held on April 11, 1984. C-84-004 was issued March 22, 1984 for failure to <br />protect topsoil at the coal stockpile. Abatement (accomplished prior to April <br />11) consisted of removing coal from the topsoil pile and from a diversion <br />above the topsoil pile. <br />NOV C-84-049 was issued March 29, 1984 for improper drainage at the portal <br />bench, failure to notify the Division of a bench slide and failure to <br />implement corrective measures. Abatement, accomplished on March 29 and April <br />12, 1984, consisted of bench regarding to establish positive drainage. <br />-10- <br />
