Long
Division Dir¢clor
Ron Nearson phoned the office this morning and we discussed his
concerns regarding our proposed issuance of the H-G Loadout permit.
Mr. Nearson said he is not requesting a formal hearing. He wanted
DMG to be aware of his concerns. We discussed each of his four
concerns.
I told him that noise issues did not fall under DMG's jurisdiction
and that this would be a county issue, related to the special use
permit which was recently issued.
I briefly described air emission permits to him and told him there
was somewhat overlapping jurisdiction between DMG and DOH, since
the emission permit is included in the mine permit. I said if he
had any problems in this area, to contact DMG or DOH.
I told him the issue of trains crossing the county road was a
county issue.
I told him trash disposal was addressed in the mine permit and that
we regulated that. I told him Peabody had not yet designated any
noncoal waste disposal area but, that they probably would soon. He
said he was not happy with past trash disposal or dust control. I
pointed out to him that Peabody was a new operator. He was not
aware that ownership of the Loadout was changing.
Mr. Nearson thanked me for answering his questions and seemed to be
satisfied that we had addressed his concerns.
c:\wp51\51893
