CONNOLLY, AND <br /> REQUEST FOR HEARING <br /> The Creditor, Darlene J. Fehr, through the undersigned counsel, submits the following <br /> objection to the First and Final Application of Block, Markus Williams, LLC for Allowance of <br /> Compensation and Reimbursement of Expenses as Counsel for Trustee, Tom H. Connolly (the <br /> "Fee Application"). In support of her objection to the Fee Application, Ms. Fehr would show <br /> this Court as follows: <br /> 1. Section 330 of the Bankruptcy Code allows the award of reasonable compensation for <br /> actual, necessary services rendered by an attorney to the debtor. Section 330(3) mandates that <br /> this Court examine a number of factors in determining the amount of reasonable compensation <br /> to be awarded, including the following: <br /> a. The time spent on the services; <br /> b. The rates charged; <br /> c. "Whether the services were necessary to the administration of, or beneficial at the <br /> time at which the service was rendered toward the completion of a case under this title"; <br /> d. "Whether the services were performed within a reasonable amount of time <br /> commensurate with the complexity, importance, and nature of the problem, issue, or task <br /> addressed"; and <br /> e. Whether or not the compensation is reasonable based on customary compensation <br /> charged by comparably skilled practitioners in non-bankruptcy cases. <br /> Based on these factors, Ms. Fehr concludes that some of the Block Markus Williams, <br /> LLC billings for the firms work in this matter are excessive. <br />
