As you know, the bond amount of each permit must be reviewed
periodically. The State statutes require that if an existing bond amount is insufficient, the operator must provide the
additional bond within 60 davs of notification. Your existing bond amount is $x,000.00. The enclosed reclamation
cost estimate amounts to $ 18,670.00, which indicates an increase of $13,670.00 in the repaired bond. You are
hereby notified of such increase
Please review the figures in the enclosed reclamation cost estimate packet. The packet consists of a one-page
summary sheet followed by detailed individual task sheets and equipment production sheets. The figures in the
packet account for the reclamation according to the approved plan in the file, in the amounts needed presently,
based on observations made during the last inspection,
These are preliminary cost figures, and it is reasonable to expect that you or your agent may contact me to discuss
revisions to them. However, this total bond amount will become effective, unless you provide better information.
have included notes on the sheets in the packet to explain the basis of quantities, grades and distances used in the
estimate. Details such as final gradients, topsoil replaced, and seed mix were taken from the approved plan in the
file. Please be reminded that the State recognizes that operators routinely perform their required reclamation for a
lesser cost than their bond amounts. However, eve must base our bond calculations on the equipment costs and
labor rotes which are charged to the State by reclamation contractors.
Please review this packet and contact me nronrotly if you notice any errors or more efficient methods of oerformin
the reL~ired reclamation. Resuonses from you or your anent, concerning modification of amp estimated reclamation
cost. should be in writing. Please be aware, however, of the 60-dav timeframe for providing the bond increase. By
State starine. I cannot extend this Deriod. but revisions to [he figures in this estimate may be made. ODera[ions with
insufficient bonds may be found in violation. The 60-day period begins on the mailing date of this letter, March 28
2001, and expires on May Z9, 2001.
PLEASE DO NOT DISREGARD THIS LETTER. IF NO BOND INCREASE IS SUBMITTED DURING THE
NEXT 60 DAYS, THIS MAY BECOME A POSSIBLE VIOLATION.
Pertbming any of the tasks associated with final reclamation will act to reduce your total bond required. I
recommend that the reclamation plan details be reviewed prior to commencing reclamation, to ensure [hat the job is
performed to specifications.
