Division staff reviewed and reevaluated the currently approved permit application <br />package, previous Division "Proposed Decision and Findings of Compliance" documents, permit <br />stipulations and their status, revisions to the permit during this term, monitoring reports, and <br />inspection reports. The enclosed document is a summary of the Division's Findings as a result of the <br />review. <br />In 1996, the Division approved apost-mining land use change to industrial, commercial, and <br />residential for the Carbon ]unction Coal Mine. A small portion of the mine permit area was <br />released for the purpose of building a golf course at that time and work on the golf course did <br />commence. Later, some reclamation work was started on the north pit area. <br />Since the original proposal to change the post-mining land use for the mine was approved, <br />conditions at the mine have deteriorated, work on the golf course ceased two years ago, the <br />gravel mining company has used up all its gravel resources and has not submitted and plans to <br />the Durango office for expansion, and to date, the Division has not received anything towards the <br />implementation of the "new" post-mining land use. It has been over fifteen years since any coal <br />was mined and this for was test burning. Market conditions do not seem to have improved and <br />there are no indications that coal mining could be profitable at this location in the foreseeable <br />future, and all recent talks with Oakridge have indicated that the mine is to be reclaimed. <br />Therefore, the impetus of this Midterm Review is [o have changes to the permit reflect that coal <br />mining has terminated, that industrial, commercial, and residential use is the approved post- <br />mining land use, and that all reclamation of coal disturbances will be reclaimed prior to the end <br />of this permit term. Please provide the Division requires detailed plans, city and county permits <br />and schedules of implementation of reclamation for the approved post-mining land uses. <br />
