There appears to be a slight disc repancy between the permitted acreage as <br />listed in the application and as depicted on surface and mineral <br />ownership maps. Specifically, the permitted acreage listed on the <br />renewal application form was 340 acres. The acreage listed for the lease <br />modification was 60 acres, a total of 400 acres. Based on the referenced <br />maps, the total permitted area is approximately 415 acres. This <br />~. discrepancy needs to be addressed and appropriate corrections made. <br />~3.4 <br />i. <br />:~. <br />~1 <br />~c_ ~ <br />~J 5 <br />Small portions of the disturbed surface area near the common corner of <br />Sections 29, 30, 31 and 32 appear to be owned by two separate <br />individuals, Wiltse and Van Camp, and the Ute Mountain Ute Tribe. A <br />description of the documents upon which legal right of entry for these <br />portions of the surface disturbance area is based should be provided. <br />An updated Certificate of Insurance as required by Rule 2.03.9 will need <br />to be submitted for inclusion in the application document. <br />Various sections of the permit application document contain discussions <br />of surface water drainage facilities and sediment ponds which are <br />outdated or incorrect. Examples are listed below. <br />Page 2.04.5(8) states "all undisturbed water is diverted to the <br />sediment pond on the west side of the access road" and "the second <br />pond handles runoff from the entire disturbed area." <br />Page 2.04.5(9) states "the sediment pond outlets or spillways are <br />constructed of eighteen inch diameter culvert pipe." <br />Page 2.04.7(3), paragraph 1, states "... this pond collects only <br />undisturbed runoff." <br />Page 2.04.7(3) states "the east pond handles runoff from the entire <br />d' turbed area." <br />e Page 2.05.6(3) contains statements which could be interpreted to <br />indicate that all undisturbed drainage from above the mine site <br />would be diverted so as to bypass the sediment ponds and flow <br />directly to the meadow. In actuality, only the east upslooe <br />drainage is diverted, while flows from the west upslope drainage <br />are routed through the west side sediment pond alonq_ with disturbed <br />runoff from a portion of the facilities area. <br />The statements noted above, as well as other sections of the text which <br />address drainage and sediment control should be reviewed for consistency <br />and accuracy, and revisions should be made as necessary to insure that <br />the text is consistent with actual and approved conditions. <br />
