-60- <br />Stipulation No. 14 <br />WITHIN NINETY (90) DAYS OF APPROVAL OF THE IAWER WASTE PILE PERMIT <br />REVISION, WEX.'C SHALL SUBMIT A REVISED WATER MONITORING PLAN THAT <br />INCLUDES MONITORING OF THE WASTE PILE. THE PLAN SHALL INCLUDE DIRECT <br />SAMPLING OF THE SEDII~Ni' POND AND UNDERDRAINS DISCHARGE TWICE PER YEAR <br />DURING THE SECOND AND THIRD QUARTER OF THE YEAR. THE PARAMETERS SHALL <br />BE THE FULL LIST OF CHEMICAL CONSTIT'[TENT'S, AT LEAST FOR THE FIRST <br />YEAR. [ACC MAY REQUEST AN AL17[JSTMENT OF THE MONITORING REQUIREMENTS <br />AFTER THE FIRST YEAR DEPENDING ON THE RESULTS OF THE MONITORING. <br />The Division finds that the operation is in compliance with the <br />requirements of this section. <br />XIX. Mine Facilities, Coal Handling Structures, Support Facilities <br />(2.05.3(3). 2.05.3(71. 4.041 <br />The mine facilities, support facilities, and coal handling structures <br />sections of the permit application have been reviewed by the Division <br />and are in compliance with the Act and rules. The mine facilities and <br />support facilities portions of the permit application can be found in <br />section 3 of Volume 1, and in Volumes 4, 5, and 6 which contain <br />construction specifications for these facilities. The coal handling <br />structures section can be found on page 3-34 and pages 3-75 to 3-78 of <br />Volume 1. <br />XX. Roads (2.05.3(3), 4.03) <br />The roads sections of the permit application are found on pages 3-23 to <br />3-24K of Volume 1 and in exhibit 3.1.1.E. <br />T1~e upper waste pile permit revision application included an access <br />road, to be used to transport waste to the upper waste pile site. This <br />road would be an approximately 2,500 foot long cut-section, gravel <br />surfaced road with grades up to 10 percent. Because of the <br />inaccessibility of the proposed road alignment, the applicant had not <br />completed a geotechnical investigation of the road corridor. In fact, <br />the completion of a geotechnical investigation would require the <br />pioneering of a roadway. T'he operator requested permission to complete <br />the geotechnical investigation and final design as the road is <br />excavated. <br />Construction of the existing roadways and surface facilities at the <br />Mt. Gunnison No. 1 Mine has entailed extensive geotechnical <br />investigation, including angering and materials testing. Numerous <br />stability analyses have been completed to analyze proposed operational <br />and reclaimed road configurations. The proposed roadway will involve <br />many similar lithologic strata and slope stability situations. For <br />this reason, the Division believed that the necessary material strength <br />information probably exists with which to complete the necessary design <br />exercise, as long as conservative assumptions are made, and later <br />verified prior to final construction of the roadway. However, the <br />
