-53- <br />Climatological Information and Air Resources (2.04.8, 2.05.4 <br />The operation has received approval from the Colorado Department of <br />Health-Air Pollution Control Division for emissions Permits Nos. <br />C-13,0-34 (1-7) relative to the proposed coal mining activities. In <br />addition, an application for modification of the emissions permit to <br />include the lower waste pile has been submitted to the Department of <br />Health. The climatology section can be found on page 2-51 of Volume 1 <br />of the application, and copies of the emissions permits can be found on <br />pages 4-38a through f of Volume 1. The operation is in compliance. <br />XI. Topsoil (2.04.9, 2.05.3(5), 2.05.4(2)(d), 4.06) <br />The topsoil management plan and soils resource information sections of <br />the application have been reviewed by the Division for compliance. The <br />soils resource information section can be found in Volume 1, page 2-153 <br />of the application, and the topsoil management plan can be found on <br />page 4-4 of Volume 1. Soils baseline, stripping, storage and <br />management plans were submitted for the area of the lower waste pile. <br />This information has been reviewed by the Division. The operation is <br />in compliance. <br />XII. Vegetation (2.04.10, 2.05.4(2)(e), 4.15) <br />The revegetation plan and baseline vegetation information sections of <br />the application have been reviewed by the Division for compliance. <br />This information was pertinent to, and the study area included the area <br />of the proposed lower waste pile. The baseline vegetation information <br />section can be found on page 2-15 of Voliane 1 of the application, and <br />the revegetation plan can be found on page 4-11 of Volume 1. With the <br />acceptance by WECC of the following stipulations, the operation is in <br />compliance. <br />The inclusion of such competitive species as pubescent wheatgrass and <br />orchard grass in the proposed temporary seed mix makes the following <br />stipulation necessary to guard against an excessively large supply of <br />these species seeds on the topsoil stockpiles. Problems with <br />establishment of the grass, fortis, and especially shrubs in the <br />permanent seed mix are lessened by severely limiting the seed reserves <br />of these competitive, introduced species in seedbed material. <br />Stipulation No. 11 <br />FOLLOWING STOCKPILING, TOPSOIL S~CKPILES THAT WILL NOT BE <br />REDISTRIBUTED FOR FIVE OR MORE YEARS SHALL BE SEEDED WITH THE PROFQSED <br />PERMAI~NI' SEED MIX (EXCLUDING SHRUBS) AND NOT THE TEMPORARY SEED MIX. <br />With the acceptance of WECC of the above stipulation the operation is <br />in compliance. <br />
