-17-
to resolve the water issues before application is made for future
mining in the Minnesota Creek drainage basin.
L~CC has provided additional information concerning their augmentation
and mitigation plans in response to the informational requests, but at
present WECC has not adequately responded to all concerns. However,
WECC will not be mining under this drainage basin during the first five
year permit term and the Minnesota Creek basin is hydrologically
separated from the extent of mining for the first five years by both a
surface and ground water divide. Consequently, no impacts are expected
within the initial five year permit term. Due to the seriousness of
the concern, however, the Division required the following stipulations
Stipulation No. 3
THE APPLICANT SHALL CONTINUE TO SUBMIT TO THE DIVISION, COPIES OF THE
REPORTS, EXHIBITS AND ALL SUBSEQUENT AN~ILI~NTS SUBMITTED TO THE
GUNNISON COUNTY PLANNING COPMIISSION, TITLED PR~TION OF NLINNESGTA
CREEK MATER SUPPLY.
Stipulation No. 4
ALL DATA AND REPORTS SUBMITTED Z'0 THE STATE ENGINEERS OFFICE AND DITCH
COMPANIES SHALL BE COPIED TO MLRD AS INCLUSIONS WITHIN THE QUARTERLY
REPORT REQUIRED UNDER SECTION 4.05.13(2) OF THE RULE'S AND REGULATIONS.
Stipulation No. 5
NEITHER WEST ELK COAL COMPANY, NOR ANY SUCCEEDING OPERATOR OF THE MT.
GUNNISON PRQIECT'S ORAL LEASES AND RESERVES WILL BE PERMITTED TO MINE
COAL WITHIN THE MINNESOTA CREEK BASIN, UNTIL MLRD HAS RExEIVID A COPY
OF AN AAILTDICATED PLAN OF AUC3~DPrATION.
water rights are not affected by the activities proposed in the lower
waste pile permit revision application. Therefore, all the findings
and stipulations of the above section are unchanged and remain in force.
IX. PROBABLE HYDROLOGIC CONSEQUENCES OF MINING AND CUMULATIVE HYDROLOGIC
IMPACT STUDY - RULES 2.05.6(3) and 2.07.6(2)(c)
This Cumulative Hydrologic Impact Study (CRIB) for the drainage basin
of the North Fork of the Gunnison River has been prepared by the
Colorado Mined Land Reclamation Division (CMLRD) pursuant to Rule
2.07.6(2)(c). This CHIS assesses the probable cumulative hydrologic
impacts of all anticipated coal mining operations upon the general area
of the North Fork of the Gunnison River Valley including the proposed
construction of the lower waste pile. Also included in this assessment
are all existing coal mines and those proposed coal mines for which
permit applications have been submitted to the Division. This study
has been prepared using information and analyses contained in the
