Box 440 Division Director <br />Rapid City, SD 57702 <br />RE: Owl Canyon Quarry, Reclamation Cost, Permit No. M-77-302 <br />Rex Quarry, Reclamation Cost, Permit No. M-77-304 <br />Deaz Mr. Grotenhouse: <br />I have reviewed the Colorado Lien Company correspondence dated March 27, 1998 and March <br />30, 1998 regazding reclamation plan and reclamation cost concerns with the Owl Canyon and <br />Rex Quarries. As previously indicated, the Division will proceed with a reclamation cost <br />evaluation for each quarry according to the criteria listed in the Division's March 3, 19981etter. <br />If Colorado Lien Company disagree's with the Division's interpretation of the reclamation <br />plan(s) as indicated in our March 3, 1998 letter and would like to address the Boazd on this issue, <br />we will schedule this matter for Boazd consideration at the next available meeting. Colorado <br />Lien Company is also welcome, at any time, to submit an application for a permit amendment <br />to revise the reclamation plan, reclamation plan maps, and required reclamation cost for each <br />quarry. <br />As you aze well awaze, the primary concern of the reclamation cost evaluation for each quarry is <br />determining the volume of overburden to be moved during backfilling and grading to achieve the <br />desired post-mining contours and land use. The Division will use the map of existing <br />disturbance submitted by Colorado Lien on January 15, 1998 to verify the volume of overburden <br />to be moved. The Division's interpretation of the reclamation plan for each quarry is that 1) <br />quarried areas will be backfilled, 2) slopes will be graded to the extent that no slope exceeds 2:1, <br />and 3) a majority of the reclaimed slopes will be graded at a slope of at least 3:1 or less steep. C <br />olorado Lien Company's interpretation of the backfill and grading requirement is that pit <br />highwalls and overburden outslopes need to be reduced only to the extent that these slopes aze no <br />greater than 2: f . The volume of overburden to be moved under these two scenazios appears to be <br />significantly different. It is the Division's position that the reclaimed slope cross sections <br />provided by Colorado Lien Company on January 15, 1998 do not follow the 3 criteria listed <br />above. <br />
