Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />stipulations an application for renewal of a valid, existing permit. This <br />document is an approval of a mining and reclamation permit, allowing only <br />reclamation at the site. <br />The application was submitted by MINREC, Inc. for the Red Canyon Mine. This <br />decision is based on a finding that the operations will comply with all <br />requirements of the Colorado State Program as found in the Colorado Surface Coal <br />Mining Reclamation Act, CRS 34-33-101 et sea•, and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made within thirty <br />(30) days of the first publication of the issuance of this proposed decision, <br />then this decision becomes final. The applicant currently has an acceptable <br />surety for $74,000.00. The permit application, all supporting documentation and <br />any stipulations or conditions will become a binding part of the permit. Nine <br />(9) stipulations appeared in the Finding Document of March 14, 1983. All but one <br />of these stipulations have been satisfied or incorporated into the Permit <br />Application. Stipulation 10, added during the 1988 permit renewal has also been <br />satisfied. Stipulation 11, added during this permit renewal, is active. <br />Stipulation No. 6 <br />THE PERMITTEE SHALL SUBMIT AN ANNUAL HYDROLOGIC REPORT BY DECEMBER 1 ff <br />EACH YEAR. THIS REPORT SHALL CONSIST OF AN ANALYSIS OF ALL MONITORING <br />DATA COLLECTED BETWEEN OCTOBER 1 AND SEPTEMBER 30 OF EACH YEAR FOR <br />1) SURFACE WATER, 2) GROUND WATER, 3) MINE INFLOWS, 4) CONSUMPTIVE USE <br />OF WATER IN THE MINE, AND 5) IMPACTS OF MINING ON THE QUALITY AND <br />QUANTITY OF GROUND AND SURFACE WATERS DURING THE PAST YEAR. THE <br />HYDROLOGIC REPORT FOR 1983 IS TO BE SUBMITTED WITHIN 60 DAYS OF PERMIT <br />ISSUANCE. <br />Stipulation No. 11 <br />RESOLVE OUTSTANDING ISSUES FROM PERMIT RENEWAL INCLUDING: <br />1) LANDOWNER NOTIFICATION REGARDING UNDERMINING <br />2) UPPER DIVERSION DITCHES <br />3) CROSS-SECTION DRAWING OF SEDIMENT POND. <br />
