Proposed Decision
The Colorado Mined Land Reclamation Division proposes to approve with
stipulations an application for renewal of a valid, existing permit. This
document is an approval of a mining and reclamation permit, allowing only
reclamation at the site.
The application was submitted by MINREC, Inc. for the Red Canyon Mine. This
decision is based on a finding that the operations will comply with all
requirements of the Colorado State Program as found in the Colorado Surface Coal
Mining Reclamation Act, CRS 34-33-101 et sea•, and the Regulations promulgated
pursuant to the Act. If no request for a formal hearing is made within thirty
(30) days of the first publication of the issuance of this proposed decision,
then this decision becomes final. The applicant currently has an acceptable
surety for $74,000.00. The permit application, all supporting documentation and
any stipulations or conditions will become a binding part of the permit. Nine
(9) stipulations appeared in the Finding Document of March 14, 1983. All but one
of these stipulations have been satisfied or incorporated into the Permit
Application. Stipulation 10, added during the 1988 permit renewal has also been
satisfied. Stipulation 11, added during this permit renewal, is active.
Stipulation No. 6
THE PERMITTEE SHALL SUBMIT AN ANNUAL HYDROLOGIC REPORT BY DECEMBER 1 ff
EACH YEAR. THIS REPORT SHALL CONSIST OF AN ANALYSIS OF ALL MONITORING
DATA COLLECTED BETWEEN OCTOBER 1 AND SEPTEMBER 30 OF EACH YEAR FOR
1) SURFACE WATER, 2) GROUND WATER, 3) MINE INFLOWS, 4) CONSUMPTIVE USE
OF WATER IN THE MINE, AND 5) IMPACTS OF MINING ON THE QUALITY AND
QUANTITY OF GROUND AND SURFACE WATERS DURING THE PAST YEAR. THE
HYDROLOGIC REPORT FOR 1983 IS TO BE SUBMITTED WITHIN 60 DAYS OF PERMIT
ISSUANCE.
Stipulation No. 11
RESOLVE OUTSTANDING ISSUES FROM PERMIT RENEWAL INCLUDING:
1) LANDOWNER NOTIFICATION REGARDING UNDERMINING
2) UPPER DIVERSION DITCHES
3) CROSS-SECTION DRAWING OF SEDIMENT POND.
