<br />Proposed Decision <br /> <br />The Division finds, based on the findings contained in this document, that the <br />81 acres reclaimed at the Canadian Strip Mine in 1987, located in portions of <br />Sections 2, 10, and 11, T8N, R78W, of the 6th P.M., are eligible for sixty <br />percent release for successful completion of backfilling and grading. <br />Rule 3.03.1(3)(d) requires the Division to retain, at a minimum, sufficient <br />bond to complete the approved reclamation plan. The release of sixty percent <br />of the current bond will result in sufficient bond being held by the Division <br />to allow for completion of reclamation at the site. Reclamation to be <br />completed includes establishment of a permanent vegetative cover and removal <br />of a sediment pond. <br />In summary, the Division proposes to release sixty percent of the liability on <br />the mine site area described above, for successful completion of backfilling <br />and grading. The total amount of bond to be released is $447,870.00. The <br />total bond remaining for the entire permit area will be $298,580.00. <br />9599E <br />
