Rrlri fu <br />a=11 <br />CC-0037 <br />SUBJECT: Recommendation to Terminate Federal Permit CO-0037 for Sunland <br />Mining Corporation's Apex #2 Mine, Routt County, Colorado <br />I. Recommendation <br />I recommend termination of Federal permit CO-0037, issued on May 31, <br />1983, for Sunland Mining Corporation's Apex #2 mine. My <br />recommendation is based on the existence of the Colorado cooperative <br />agreement which provides for the delegation to the Colorado Mined Land <br />Reclamation Division (NERD) of the permitting responsibilities for <br />operations on Federal lands pursuant to Section 523 of SMCRA; the <br />issuance of the Colorado State permit C-81-011; incorporation of all <br />necessary Federal permit conditions in the State permit; and review of <br />the mining plan approved on May 31, 1983. for Federal leases, D-04654 <br />and C-0127592. Attached to this memorandum are the applicable <br />standard conditions of approval of the Apex #2 sine mining plan <br />approved by the Assistant Secretary on Map 31, 1963, for Federal <br />leases, D-046544 and C-0127592. These conditions were previously <br />incorporated in the Federal permit. Notwithstanding the termination <br />of the Federal permit, these conditions will remain in full forte and <br />effect. <br />The termination of the Federal permit is being done in conjunction <br />with the renexal of Colorado State permit C-81-011. Colorado MLRD has <br />reviewed the permit application package (PA_°) under the Colorado State <br />program, the Federal lands program (30 Cr^R Chapter VII, Subchapter D) <br />and the Colorado cooperative agreement (30 CFR 906.30) and has issued <br />Colorado permit C-B1-011 which authorizes surface coal mining and <br />reclamation operations on Federal and non-Federal lands in the permit <br />area pursuant to the State program and cooperative agreement. A copy <br />of the bond in the amount of $82,420, payable to the United States an3 <br />the State of Colorado, is on file with OSMRE. <br />
