Ms. Wojtach documented two six-minute opacity averages of 71.04% and 72.29%, in violation <br />of the 10% opacity standazd required by Permit No. 97P00603, condition 8(b), and Subpart <br />000, § 60.672(b). <br />4. On September 5, 2001, Ms. Shannon McMillan, of the Division, conducted a <br />compliance inspection at the Quarry. Accompanying.Ms. McMillan, and also from the Division, <br />was Mr. Doug Ryder. The inspection included opacity observations and a review of records for <br />various permitted sources at the Quarry. <br />a. Ms. McMillan documented a single six-minute opacity average of 31.88% at the <br />transfer point from-the primary cone to a conveyor belt, in violation of the 10% <br />opacity standazd required by Permit No. O1P00474, condition 9(b), and Subpart <br />000, Section 60.672(b). <br />b. Mr. Ryder documented a single six-minute opacity average of 12.92% from the <br />secondary cone crusher to the conveyor belt, in violation of the 10% opacity standazd <br />required by Permit No. 97P00603, condition 8(b), and Subpart 000, Section <br />60.672(b). <br />5. Agile installed and periodically operated four portable diesel generators, each <br />without an Air Pollutant Emission Notice ("APEN") and an approved construction permit, from <br />August 22 through September 2Q 2001, in violation of AQCC Regulation No. 3, Part A, Section <br />II.A and Part B, Section III.A.1 and §§ 25-7-114.1 and25-7-114.2, C.R.S. <br />6. Agile's records indicate that the electric generator associated with the distillate- <br />fuel oil-fired reciprocating internal combustion engine ("genset" -Caterpillar, Mode13512B, <br />serial number 24209649) operated ten hours per day at 100% load with coolant temperatures <br />ranging from 175°F up to 210°F from January 8, 1998 through the Quarry's shutdown, in <br />violation of Permit No. 97P00598, condition 6, which requires the generator to run no more than <br />nine hours per day at 100% load and a coolant temperature no higher than 140°F. <br />7. On October 10, 2001, Ms. Stutzman documented two six-minute opacity averages <br />of 32.92% and 33.75% from the transfer point from the secondary cone crusher to the conveyor <br />belt, in violation of the 10% opacity standard required by Permit No. 97P00603, condition 8(b), <br />and Subpart 000, Section 60.672(b). <br />8. Agile operates a.rail car loadout facility that is designed to transfer materials from <br />the Quarry to various other locations in Colorado. Agile operated the rail caz loadout from <br />January 1998 through the Quarry's shutdown without submitting an APEN or obtaining a <br />construction permit, in violation of AQCC Regulafion No. 3, Part A, Section II.A and Part B, <br />Section III.A.1, and §§ 25-7-114.1 and 25-7-114.2, C.R.S. <br />9. On February 20, 2003, Ms. Stutzman documented a single six-minute opacity <br />average of 22.50% from a portable generator in operation at the Quarry, in violation of the 20% <br />opacity standazd required by Pemut No. 97P00598, condition 2 and AQCC Regulation No. 1, <br />Section II.A.1. <br />
