Special Conditions
the Mining Plan Approval
for the Mt. Gunnison No. 1 Mine
Special Condition 1. At such time as OSM, in consultation with the Colorado
Mined Land Reclamation Division and the SHPO, determines
that subsidence within the permit area may adversely
affect known or unrecorded cultural sites, additional
cultural resources studies may be required. This
determination will be based on new subsidence or new
cultural resources information.
Special Condition 2. Surface facilities, occupancy, surface disturbance,
industrial fires and subsidence will not be permitted in
the eagle or Cooper's hawk nests buffer zones. With
approval of the Bureau of Land Management, some surface
activities may be permissible in the buffer zone at
times other than the breeding/rearing season or if the
nests are inactive.
Special Condition 3. Surface disturbance in the North Fork of the Gunnison
• River affecting aquatic habitat may be permitted in the
stream habitat with the approval of the Bureau of Land
Management after consultation with the Colorado Division
of Wildlife. Surface disturbance includes surface
facilities, subsidence channel modifications, and
reduction of water quality to not less than receiving
stream standards.
Special Condition 4. Surface disturbance within a 1/8-mile riparian buffer
zone may be permitted with the approval of the Bureau of
Land Management after consultation with the U.S. Fish
and Wildlife Service.
Special Condition 5. Within 90 days of mining plan approval, the applicant
must submit a corrected rider to Federal Insurance
Company bond 8089 33 08 that correctly shows the State
of Colorado and the United States of America CU.S.A.) as
co-obligees; or provide evidence that the responsibility
of the applicant toward the U.S.A. as an obligee of the
total bond amount is not jeopardized by the omission of
the U.S A. as coobligee on the rider.
Special Condition 6. This approval does not affect the outcome of the
challenge to permit issued by OSM in 1981, now pending
before Interior Board of Lands Appeals. If any
additional conditions are required by that decision,
this approval may be modified accordingly.
