From: Director, Office of Surface Mining /' (~ Subject: Recommendation for Approval of the Mt. unaison No. 1 Mine Mining Plan Modification, West Elk Coal Company, Gunnison County, Colorado, Federal Leaae C-1362 I recommend approval of the Mt. Gunnison No. 1 mine mining plan modification pursuant to the Mineral Leasing Act of 1920, as amended. My recommendation to approve the Weat Elk Coal Company's mining plan modification ie based on: (1) the company's permit application package (PAP) as submitted and updated through September 12, 1985, (2) review of the PAP by the State as required by the Colorado State Program and cooperative agreement, (3) review of the operation and reclamation plan portion of the permit application by the Office of Surface Mining, (4) the Federal lands review pursuant to section 522(b) of the Surface Mining Control and Reclamation Act of 1977 (SMCRA), (5) comments sad recommendations or concurrences of other Federal agencies, including the findings sad recommendations of the Bureau of Land Management with respect to the resource recovery sad protection plan sad other requirements of the lease and the Mineral Leasing Act of 1920, as amended, (6) compliance with the National Environmental Policy Act of 1969, sad (7) documentation assuring compliance with applicable requirements of other Federal laws, regulations and executive orders. The Secretary may approve a mining plan modification for Federal lands under 30 II.S.C. 207(c) and 1273(c). I find that the proposed operations will be in compliance with all applicable laws and regulations, sad I recommend the Mt. Gunnison No. 1 mine mining plan modification, updated through September 12, 1985, be approved. Approval of this mining plan modification will not affect the pending challenge to the issuance of the 7uly 1981 Mt. Gunnison No. 1 mine permit. Approval: I approve the Mt.
