Simpson <br />State Engineer <br />R~~ ~:,~ ~, '° <br />r', <br />OCT 2 6 1992 <br />roY1NEr.,.~. c . _ <br />Thank you for the referral to review the applicant's request to [nine an addidona19.85 acres <br />in addition to the 83 acres previously approved in the existing gravel mining operation. The site <br />is located at the southeast corner of CR 9E and CR 20 in Loveland. The applicant plans to extract <br />additional gravel and return the site to a wetland condition. <br />According to our files, the applicant was given approval to divert water out-of-priority for <br />the gravel mining operations pursuant to our April 6, 1992 letter (copy attached). As noted in this <br />letter, the applicant is restricted to a total surface azea of 24.3 acres and total depletions aze limited <br />to 27.27 acre-feet per year. !t is my understanding from the applicant's submittal there will most <br />likely be additional ground water exposed in the expansion of the operation. As such, the applicant <br />may not have approval from this office for such expansion. <br />In addition, the applicant was noticed to obtain a valid gravel pit well permit prior to <br />exposing ground water. A review of our files indicates that the permit has not been issued. If <br />ground water has been exposed from the original operation or from the expansion, the operator <br />is in violation of State statutes. <br />It is recommended that the applicant contact this office and present a detailed plan as to <br />the extent of additional ground water to be exposed or out-of-priority diversions to take place. In <br />addition, a valid permit must be issued prior to exposing ground water. Based on these outstanding <br />issues, this office cannot recommend approval of the applicant's request. <br />
