We talkefl about the attempt to repair the <br />cabin, do to the subsidence of the under ground mining. <br />The items were discusses as to the letter which I faxed to you on <br />Friday and 3 more items were brought to their attention, which <br />now shows damage. <br />1. Tha other damage is where the furnace room has damage, <br />the room that is attached to the main building is pulling away <br />from the cabin. <br />2_ The front of the cabin on the North end on the out Side <br />down by the footer has a gap, between the footer and the <br />building. <br />3. The floor in the hall way has a hump in it. We have <br />water lines going to the bath rooms in this vicinity, also the <br />radiant heat in the floor. <br />The on going problem with the cabin is that the damage is not <br />corrected nor was it done by September 17, per Larry's letter to <br />Phil Schmidt. Norm Avery said that West Elk is taking <br />responsibilty for the damage to the cabin. <br />I was also told by Norm Avery that he took in an appraiser this <br />morning, which West Elk did not tell us that they were going to <br />be at the cabin at all this morning. I guess they can trespass <br />on our property any time they want. <br />P.02 <br />The other problem which 1 saw today is that West Elk Mine is <br />dumping more subsoil on the gob pile. They are fligging up the <br />road base beside the new fan and moving it in on top of the gob <br />
