15. The sacks in which [he ore is stored are permeable. The sacks are not covered during storage to protect <br />the sacks from moisture. There is no liner beneath the storage area. Thus, there is no protection from <br />potential acid leachate that could farm after precipitation infiltrates the sacks, percolates through the ore <br />and leaches out the bottom of the sacks into the ground. The surface of this storage azea is grave]. There <br />is no evidence of any natural impermeable layer beneath the gavel. Groundwater is shallow and there <br />is a pond down-slope from the storage azea. <br />16. Nevertheless, Petitioner has been storing material at this location for approximately five yeazs. The <br />sacks are normally stored for a period of less than two weeks, and would not be stored for a period <br />greater than ninety days. The Division has inspected the site since this storage activity began. There is <br />no visible evidence of contamination. There is no evidence that the sack storage has impacted the <br />parking lot to a degree that would require reclamation. <br />17.
