The proposed operation is in compliance. <br />XXI. Bonding (2. 05.4(2)(b)) <br />The operation is presently bonded in the amount of SI00,000.00. Reclamation <br />costs, as estimated by the Division, are as follows: <br />1) Demolition and removal of surface facilities - $12,000.00 <br />2) Backfilling and grading costs - $52,000.00 <br />3) Topsoil acquisition and transportation - $23,500.00 <br />4) Revegetation cost - $10,000.00 <br />TOTAL COST - $97,500.00 <br />As :rentioned above, the operation is currently bonded in the amount of $100,000.00. <br />The Division finds this amount adequate to cover the cost of reclamation. <br />The proposed operation is in compliance. <br />XXII. Sealing of Drilled Noles and Underground Openings (2.05.4(2)(8), 4.07) <br />The applicant proposes to seal the mine portals upon abandonment of the under- <br />ground workings by backfilling the portal openings with spoil, underground <br />development waste and sediment from sediment ponds available upon the mine site. <br />In addition, the applicant proposes to use overburden in the near surface <br />portion of the portal entries, in order to assure closure of the mine entries. <br />As such, this proposed :r~thod conforms with M.S.N.A. regulations as stated in <br />30 CFR 75-1711.3 of the Federal Code of Regulations. Zn addition, the hydro- <br />logic information contained within the permit demonstrates that effluent flow <br />will not occur at the site of the portals following abandonment. Further, <br />the applicant proposes to seal all non-permitted wells and bore holes with a <br />concrete plug. <br />The proposed operation is in compliance. <br />XXII1. Subsidence (2.05.6(6), 9.20) <br />National King Coal has demonstrated that only one structure and no renewable <br />resource lands exist within those areas of potential ground surface subsidence. <br />The one potentially affected structure is a small irrigation ditch. In response <br />to comments included within the Division's preliminary adequacy review, the <br />applicant has submitted agreements between the landowner and the company <br />recognizing the possibility of subsidence effects upon the ditch and granting <br />National zing Coal the right to access in order to affect needed repairs. <br />The amended application also includes a commitment by National King Coal to <br />visually monitor for effects of subsidence within the permit area on a quarterly <br />basis. In the case of this particular structure, limited to use by the overlying <br />landowner, such a monitoring program and subsidence program suffice to satisfy <br />the subsidence control and monitoring requirements of Rv1e 2.05.6(6)(f). <br />The proposed operation is in compliance. <br />
