I realize that I suggested many problems to you quickly after our
meeting before the Board yesterday. I would like to give you a written
list to perhaps emphasize my remarks.
Probably the most frustrating problem is created by the frequent change
of inspectors. When one or maybe even several inspectors state that a
certain item is in compliance, a new inspector may suddenly take the
opposite stance.
The Division was approximately two years late initiating our midterm
review. We answered the adequacy concerns in timely fashion without any
response from the Division. We consider that our answers have been
accepted.
The Division is approximately two months late in issuing any adequacy
concerns to our permit renewal. We should also consider that there are
no concerns and that we are adequate.
The Division agreed to design the West pit diversion and drainage
utilizing professional standards. We have notified the Division of
several errors in the design, and we hope that corrections of
engineering might be made prior to actual construction.
The next point is being made to show that the Division has the ability
to violate the rules and regulations; we do agree with the actual
practice. The tipple pond is going to be remove prior to revegetation
without any demonstration of lack of suspended solids contribution to
the receiving streams. When we raised this point with Cathy Begej, she
said: "we [the division] can do anything that we want to."
We will try to meet with Pfr. Renner some time soon.
