I would like to give you a written <br />list to perhaps emphasize my remarks. <br />Probably the most frustrating problem is created by the frequent change <br />of inspectors. When one or maybe even several inspectors state that a <br />certain item is in compliance, a new inspector may suddenly take the <br />opposite stance. <br />The Division was approximately two years late initiating our midterm <br />review. We answered the adequacy concerns in timely fashion without any <br />response from the Division. We consider that our answers have been <br />accepted. <br />The Division is approximately two months late in issuing any adequacy <br />concerns to our permit renewal. We should also consider that there are <br />no concerns and that we are adequate. <br />The Division agreed to design the West pit diversion and drainage <br />utilizing professional standards. We have notified the Division of <br />several errors in the design, and we hope that corrections of <br />engineering might be made prior to actual construction. <br />The next point is being made to show that the Division has the ability <br />to violate the rules and regulations; we do agree with the actual <br />practice. The tipple pond is going to be remove prior to revegetation <br />without any demonstration of lack of suspended solids contribution to <br />the receiving streams. When we raised this point with Cathy Begej, she <br />said: "we [the division] can do anything that we want to." <br />We will try to meet with Pfr. Renner some time soon. <br />Sincerely, <br />W.D.
