Richard D. Lamm
Governor
'~ DEPARTMENT OF NATURAL RESOURCES
David H. Catches. Executive Director
MINED LAND RECLAMATION DIVISION
DAVID C. SHELTON, Director ,
November 19, 1984
Mr. Leon Every
National King Coal, Inc.
P.O. Box 2905
Durango, Colorado 81301
RE: Mid-Term Review of the King Coal Mine, Permit No. C-035-81
Dear Mr. Every:
III IIIIIIIIIIIIIIII
Attached is a copy of the Division's draft Mid-Term Review and Decision to
require revisions to the King Coal Mine, Permit No. C-035-81. This review is
in fulfillment of Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5),
and 3.02.2(4).
The mid-term review consisted of reviewing the permit application and
commitments made there in, stipulation responses, revisions, and any
supplemental information, as well as information from field inspections and
past inspection reports. The main purpose of the review was to identify any
areas of the permit application that will need to be revised or modified to
ensure compliance and reflect the current status of the mine.
The attached document contains our mid-term review, a rationale for requiring
any revisions to the application, timetables for submitting responses, a
summary of the status of stipulations, the results of our performance bond
review, and a summary of significant issues.
Revisions were found to be needed under the categories of legal, financial and
compliance information, subsidence information, and water monitoring
requirements. Your responses to the legal, financial and compliance
information, and subsidence information, must be submitted to the Division as
minor revisions by December 31, 1984. The required water level monitoring
information can be submitted as part of each quarterly water monitoring report.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
