Banla. <br />D,vs,on D.reaar <br />We have reviewed your letter of January 22, 1990, and we find that two issues, <br />portal bench backfilling and post reclamation sediment control have not been <br />satisfactorily addressed. <br />With regard to the back filling plan, the cross sections submitted depict <br />backfilled slope gradients ranging from 75% to 125%. These slope gradients <br />significantly exceed gradients set forth in the approved plan, and the <br />criteria we outlined in the December 15, 1989 letter to you. In that letter, <br />we stated that we would "require that the maximum highwall height reduction <br />possible be achieved, given the material available within the mine bench and <br />the constraint of a final reclaimed slope gradient average of between 40~ and <br />50%, with no slope segment steeper than 60%." The enclosed cross sections <br />based on the survey based topographic map we had forwarded to you earlier <br />depict acceptable reclamation profiles. The slope should be achievable based <br />on material available in the fill bench and would result in a more stable, and <br />a more easily reclaimable topography than that depicted in the January 22 <br />letter. The regrading plan as depicted in the January ZZ letter will need to <br />be revised in accordance with the criteria outlined above and will need to be <br />submitted to us by February 15, 1990. <br />The need for an alternative sediment control plan to be implemented prior to <br />removal of the existing sediment pond on Mr. Sarver's property was addressed <br />under Task 18 of our December 15 letter. Your January 22 letter did not <br />respond to Task 18. We will need a written commitment from you prior to the <br />February 21 Board meeting specifying than an appropriate alternative sediment <br />control plan will be submitted by June 1, 1990. <br />Your letter of January 22 questions whether or not you should have a <br />representative at the February 21 Board Meeting. That decision is entirely up <br />to you. If acceptable plans are submitted by February 15, as requested, we <br />will prepare a letter of agreement for your signature and we will recommend to <br />the Board that your request be approved.
